Terms of Service

These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between you ("User," "Customer," "Buyer," or "you") and NJTechland LLC, a New Jersey limited liability company ("NJTechland," "we," "us," or "our"), operating at njtechland.store and njtechland.com (the "Site").

BY ACCESSING THE SITE, PLACING AN ORDER, SUBMITTING A QUOTE REQUEST, OR USING ANY OF OUR SERVICES, YOU UNCONDITIONALLY ACCEPT AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SITE OR PURCHASE ANY PRODUCTS OR SERVICES FROM US.

We reserve the right to modify these Terms at any time. Continued use of the Site after modifications constitutes acceptance of the updated Terms.

You must be at least 18 years of age and legally capable of entering into binding contracts to use this Site or purchase from us. By using this Site, you represent and warrant that you meet these requirements. Purchases made for business purposes represent that you have authority to bind the business entity to these Terms.

NJTechland serves business customers (B2B) and consumers. Commercial buyers acknowledge additional terms may apply based on the nature of their purchase, project, or deployment agreement.

All product descriptions, specifications, images, and prices are provided in good faith and subject to change at any time without notice.

Pricing Errors: In the event of a typographical error, incorrect pricing, or listing mistake, NJTechland reserves the right to cancel any order placed at the erroneous price and will notify the customer promptly. We are not obligated to fulfill orders placed based on pricing errors.

Availability: All products are subject to availability. We reserve the right to limit quantities per customer, per order, or per time period without notice. Backordered items will be communicated to customers as promptly as practicable.

Manufacturer Changes: Product specifications, configurations, and included accessories are subject to change by manufacturers without notice. NJTechland is not liable for minor specification changes that do not materially affect product performance.

All sales are final for custom-configured, special-order, or drop-shipped items.

Your submission of an order constitutes an offer to purchase and does not constitute a binding contract until we issue an order confirmation. NJTechland reserves the right, in its sole and absolute discretion, to accept, reject, or cancel any order for any reason, including but not limited to:

•Product unavailability or stock errors

•Pricing or description errors

•Suspected fraud, resale restrictions, or export control violations

•Unusual or bulk order quantities without prior approval

•Inability to verify payment or shipping information

•Geographic restrictions or shipping limitations

If your order is cancelled after payment, you will receive a full refund via the original payment method within 5–10 business days.

Order modifications requested by the customer after confirmation may not be possible and are at NJTechland's sole discretion.

Payment is due at the time of order placement unless otherwise agreed in writing (net terms for approved business accounts only). We accept major credit cards, ACH transfers, and wire transfers for qualifying orders.

All transactions are processed in United States Dollars (USD). You are responsible for any applicable taxes, duties, import fees, or currency conversion charges.

Fraudulent Transactions: Any attempt to use fraudulent payment methods, stolen credit cards, or unauthorized billing information is a violation of these Terms and applicable law. NJTechland will report confirmed fraud to relevant law enforcement authorities and pursue all available legal remedies including civil claims for damages.

Chargebacks: Initiating a fraudulent or unjustified chargeback against NJTechland constitutes a breach of this Agreement. You agree to pay all costs, including reasonable attorneys' fees, incurred by NJTechland in disputing fraudulent chargebacks. A $50 administrative fee may be assessed per chargeback dispute.

NJTechland ships to addresses within the United States. Delivery timeframes are estimates only and are not guaranteed. NJTechland is not liable for delays caused by carriers, weather events, customs, acts of God, labor disputes, or other circumstances beyond our reasonable control.

Risk of loss and title to products transfer to the buyer upon delivery of the goods to the carrier. NJTechland is not responsible for products lost, stolen, or damaged after delivery has been confirmed by the carrier.

Refused Deliveries: If a shipment is refused or undeliverable due to customer error, the customer is responsible for return shipping costs and a restocking fee of up to 20% of the order value.

Freight Damage: Claims for shipping damage must be made within 48 hours of delivery with photographic documentation submitted to services@njtechland.com. Claims submitted after 48 hours may not be honored.

Standard Returns: We accept returns of stock items within 30 days of the delivery date, provided items are in original, unused, unregistered condition with all original packaging, accessories, and documentation intact.

Non-Returnable Items:

•Custom-configured, special-order, or made-to-order products

•Software, licenses, and digital products (once activated or downloaded)

•Products with removed or damaged serial number labels

•Consumable items (cables, batteries, toner cartridges) once opened

•Items showing signs of use, damage, modification, or missing components

•Products returned beyond the 30-day window

Restocking Fee: A restocking fee of up to 20% may be applied to returns that are not the result of NJTechland's error.

Return Process: To initiate a return, email services@njtechland.com with your order number, product details, and reason for return. An RMA (Return Merchandise Authorization) number will be issued. Returns without an RMA number will not be accepted.

Refunds: Approved refunds are processed within 5–10 business days of receiving and inspecting the returned item. Shipping costs are non-refundable unless the return is due to our error.

Warranty Claims: Products covered by manufacturer warranty must be submitted directly to the manufacturer unless NJTechland is the authorized warranty service center for that product.

Where NJTechland provides installation, configuration, deployment, or professional services ("Services"), the following terms apply:

Scope of Work: Services are performed based on the agreed scope. Any changes to scope must be approved in writing. Additional out-of-scope work will be billed at our then-current rates.

Site Conditions: Customer is responsible for ensuring safe, accessible, and code-compliant site conditions prior to our technicians' arrival. NJTechland is not liable for delays or additional charges resulting from inadequate site preparation.

Pre-Existing Conditions: NJTechland is not responsible for pre-existing infrastructure deficiencies, code violations, or concealed conditions discovered during installation. Such conditions may result in additional charges or service postponement.

Permits & Compliance: Customer is responsible for obtaining all required permits, licenses, and approvals. NJTechland is not responsible for permit delays or compliance issues.

Service Guarantee: We stand behind our workmanship. Installation defects reported within 30 days of service completion will be remedied at no charge. This guarantee does not cover damage from misuse, unauthorized modifications, or acts of third parties.

Cancellations: Service appointments cancelled less than 24 hours in advance may be subject to a cancellation fee of up to 25% of the scheduled service cost.

All content on this Site, including but not limited to text, graphics, logos, images, product descriptions, guides, comparison articles, and software, is the exclusive property of NJTechland LLC or its licensors and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, or exploit any content from this Site without express written permission from NJTechland.

Unauthorized use of our intellectual property may result in civil and/or criminal liability.

You agree NOT to use this Site or our services to:

•Violate any applicable law, regulation, or ordinance

•Submit false, misleading, or fraudulent information in any form

•Impersonate any person or entity or misrepresent your affiliation

•Engage in unauthorized scraping, crawling, or data harvesting

•Introduce malware, viruses, or malicious code

•Attempt to gain unauthorized access to any system, account, or data

•Use automated bots, scripts, or tools to place orders, submit forms, or manipulate pricing

•Engage in any activity that disrupts, damages, or impairs the Site

•Purchase products for export in violation of U.S. export control laws

•Resell NJTechland products in violation of manufacturer restrictions

Violations may result in immediate account termination, order cancellation, forfeiture of any payments made, and referral to law enforcement.

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NJTECHLAND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

PRODUCT WARRANTIES ARE PROVIDED BY MANUFACTURERS, NOT BY NJTECHLAND, UNLESS EXPRESSLY STATED IN WRITING. NJTECHLAND MAKES NO INDEPENDENT WARRANTY AS TO MANUFACTURER-WARRANTED PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NJTECHLAND LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

•INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

•LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES

•DAMAGES ARISING FROM BUSINESS INTERRUPTION, NETWORK DOWNTIME, OR SYSTEM FAILURES

•DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

IN ANY EVENT, NJTECHLAND'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO NJTECHLAND IN THE 90 DAYS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless NJTechland LLC, its officers, directors, employees, agents, partners, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

•Your use of the Site or our services

•Your violation of these Terms

•Your violation of any third-party rights

•Your violation of any applicable laws or regulations

•Any fraud, misrepresentation, or intentional misconduct by you

•Any dispute between you and a third party

This indemnification obligation survives termination of these Terms and your use of the Site.

Informal Resolution First: Before initiating any formal legal proceeding, you agree to contact us at legal@njtechland.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising from or related to these Terms or your use of the Site shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except for claims that qualify for small claims court.

Class Action Waiver: YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST NJTECHLAND.

Governing Law: These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any court proceedings (for matters not subject to arbitration) shall be held exclusively in Union County, New Jersey.

Time Limitation: Any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred.

Participants in NJTechland's reseller program are subject to additional terms in the Reseller Agreement. Key provisions include:

•Commission rates are established in writing and subject to change with 30 days' notice

•Resellers may not misrepresent NJTechland's products, pricing, or capabilities

•NJTechland reserves the right to terminate reseller status for any violation of program terms

•Commission payments are contingent on successful order completion and non-reversal

•Resellers are independent contractors, not employees or agents of NJTechland

NJTechland shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, acts of God, pandemics, war, terrorism, labor strikes, government actions, supply chain disruptions, carrier failures, cyberattacks, or internet infrastructure failures.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Any invalid provision shall be modified to the minimum extent necessary to make it enforceable.

These Terms, together with our Privacy Policy and any other agreements expressly incorporated herein, constitute the entire agreement between you and NJTechland regarding your use of the Site and supersede all prior or contemporaneous agreements, representations, and understandings.
